We work exclusively on the basis of the latest version of the German Freight Forwarders' Standard Terms and Conditions (ADSp). In section 23 ADSp, these limit the statutory liability for damage to goods in accordance with § 431 of the German Commercial Code (HGB) for damage in the forwarder's custody to € 5.00/kg; in the case of multimodal transports including carriage by sea to 2 SDR/kg and, in addition, to 1.0 million or 2.0 million or 2 SDR/kg, whichever is the greater, per event of damage or loss. Section 27 ADSp shall not be deemed to be an agreement on other maximum liability amounts within the meaning of Art. 25 Montreal Convention.
